1. General Conditions of Sale
The conditions and rules presented herein by Maison Edouard are being provided in accordance with all applicable laws. Henceforth this document will be known collectively as the General Conditions of Sale. It will pertain to any and all purchases from Maison Edouard, Zhuhai Muse-E Apparel Co. Ltd., (hereinafter to be designated as "ME", we", "us", or "our") a company registered in accordance with Chinese laws, whose registered address is Rm 402, 44 Bao Zhong Rd, Hengqin Town, Zhuhai, Guangdong, China, [INSERT APPROPRIATE POSTAL CODE # HERE] by you, (hereinafter to be designated "the customer" or "you").
Purchases may be conducted on the Maison Edouard Websites on the Internet at the domain nameswww.maison-edouard.com and www.maison-edouard.fr (hereinafter to be designated the "Website") or through our Customer Service Center, whose telephone number and email address are listed on our Websites.
These General Conditions of Sale apply exclusively to all purchases made via our Customer Service Center or our Website.
The General Conditions of Sale which apply to all orders placed with our Customer Service Center or on our Website will be those in effect at the time an order is placed with a Customer Service Representative at our Customer Service Center or by the customer on our Website. When placing orders on our Website checking the "I agree" or similar box constitutes full acceptance of our General Conditions of Sale. If you refuse to accept our General Conditions of Sale you cannot order from our Website or Customer Service Center.
2. Our Terms of Purchase
Only persons who (a) are adults (eighteen years of age in most countries), (b) possessing the legal capacity to conduct business and enter into binding contracts and if you have not reached the age of adulthood or for any other reason you do not possess the capacity to enter into a legally binding contract then a parent or guardian or legal representative with said capacity must place the order for you on your behalf and approve of our General Conditions of Sale. Any order placed in violation of this clause shall be rendered null and void.
3. Product Availability
All orders placed through our Customer Service Center or our Website are subject to availability and the approval and consent of ME.
Our Customer Service Center and our Website product pages provide up to date information about which products we currently offer for sale. Please note that only products with an "Add to Cart" feature may be purchased on our Website. You may also contact our Customer Service Center by calling the telephone number provided on our Website to place an order. A Customer Service Representative will provide you with product availability information and guide you through the purchase process.
4.ACCOUNT REGISTRATION AND PERSONAL INFORMATION
To place an order on our Website or through our Customer Service Center you, or the ME Customer Service Representative (on your behalf) must create and register an online account or select the "Guest Checkout" option on our Website or through our Customer Service Center instead. To register you must provide us with valid, current, personal information, such as your name, phone number, and email address and confirm that you are an adult.
After completing your account registration on our Website or with the ME Customer Service Representative you will be sent an email to allow you access to your account on our Website to create a permanent identifier and password in connection with your account. You may also be sent a second email summarizing the personal information you provided to us while registering your account. It is your responsibility to ensure the permanent secrecy and security of your password, as well as access to your account. ME cannot be held responsible for any third party access to your account, use of your password or login to your account.
ME may occasionally modify the information required to place a new order or register an account. Any changes will be published on our Website.
In addition, if ME has any reason to suspect a third party violation or unauthorized use of a customer account, password and/or account login has occurred ME will immediately terminate and cancel the account. You will be notified of any such cancellation via telephone or email.
5. Placing Orders
When placing an order on our Website you must first choose a product and then use the "Add to Cart" feature to place it in your shopping cart. You may continue to add products (subject to our availability limits) to your shopping cart or delete them at your discretion. You may complete your purchase by accessing the "Order" feature to allow for payment and checkout.
An ME Customer Service Representative will assist you when placing an order with our Customer Service Center via the telephone number provided on our Website.
6. Prices, Taxes and Shipping
Except as otherwise stipulated all of the prices on our Website and quoted by our Customer Service Center Representatives include VAT and any and all other applicable taxes but exclude applicable shipping charges. ME will bill you
in either Euros, GBP or USD, depending on the shipping address you've chosen as the destination for your purchase.
ME reserves the right to change our prices and shipping charges as necessary at our sole discretion at any time.

Shipping charges will be added to your product costs after you've selected your delivery options.

7. CUSTOMER CONFIRMATION AND VERIFICATION
We highly recommend that you carefully check all order details prior to final submission to the Customer Service Center or our Website. This should include, but not be limited to all information specific to each sale, any information provided by a Customer Service Representative for orders placed through our Customer Service Center and information on our Website for Website orders.

By sending your order you're submitting an offer to ME to buy the products placed in your >>Shopping Cart<<.
In addition to any other provisions herein ME retains the right to refuse, cancel or terminate any order at any time for a legitimate reason. For example, ME may refuse, cancel or terminate an order for an ongoing payment dispute involving a previous order, or if ME suspects attempted fraud or any violation of our Terms and Conditions.
8.1. Credit Card or Debit Card Payment
All credit card and debit card payments are subject to validation and card issuer authorization. If the card issuer refuses to authorize payment to ME you must contact them directly in order to resolve the issue. ME will not be held responsible for delayed or undeliverable orders under such circumstances.
The purchase amount of your order will be processed for payment authorization with your card issuer upon shipment to the shipping address you've provided to ME. At that time you'll be sent an Order Confirmation and your card will be charged the applicable purchase price.
Submission of a purchase offer to ME on our Website or through our Customer Service Center expressly authorizes us to execute prior authorization of your payment card, and, if ME deems it necessary, to receive or transmit information (including updated information) regarding you (or your third party), including, but not limited to, your payment card number to authenticate your identity, validate your payment card, get an initial payment authorization, and authorize individual purchase transactions.
This contract authorizes revenue payment processing services for goods and/or services purchased on our Website or through our Customer Service Center by credit card or debit card, for whichever payment method is used to purchase said goods and/or services.
8.2. Bank Transfer Payments
Bank transfer payments are acceptable for all Customer Service Center and Website orders exceeding 60 Euros. You must ensure your Order Reference Number is on the bank transfer form. After placing your order and choosing a bank transfer as your payment option, ME will wait until we receive your payment before processing your order. If your payment is not credited to our bank account within seven (7) business days of placing your order, then your order will be cancelled.
ME will not charge you a commission for a bank transfer. We must receive the entire payment amount indicated on your Order Acknowledgement of Receipt before we will process your order. Please note that some financial institutions may charge you a fee for a bank transfer.
To secure your transaction and prevent fraud ME will conduct verification and fraud control checks of your information. By placing your order you are deemed to have authorized ME to make these checks, and as ME deems necessary, for us to punctually transmit and/or receive information you've provided about yourself to us, in order to authenticate your identity, validate your credit card, obtain an initial credit authorization and to authorize a purchase transaction in particular.
9. ORDER ACKNOWLEDGEMENT OF RECEIPT
After placing your order on our Website or through our Customer Service Center you will receive an Order Acknowledgement of Receipt via email. It will contain your order details, our Terms and Conditions and an Order Reference Number. Upon receipt of this email it is your responsibility to check your order details, our Terms and Conditions and save your Order Reference Number for all future correspondence regarding your order.
The Order Acknowledgement of Receipt does not constitute acceptance of your order by ME. Following the transmission of your Order Acknowledgement of Receipt ME will then proceed with the usual security checks and process your order.
10. ORDER CONFIRMATION
After conducting the usual security checks, ME will issue you an Order Confirmation via email upon the shipment of your order. This Order Confirmation constitutes acceptance of your order by ME, initiating the existence of an obligatory sales contract.
ME will retain all order information as required by applicable law. This information will be available to you on our Website under "My Maison Edouard Website" or through our Customer Service Center.
11. SHIPPING POLICY
Please note that ME will NOT ship orders to PO Box addresses, nor to hotels, nor to any of the following areas listed here below:

Delivery charges and estimated delivery times will be provided on our Website or by our Customer Service Representative when you place your order and they will be summarized in your Order Acknowledgement of Receipt.
With all delivery time estimates please remember that credit card approval or bank transfer time, address verification and processing must all be taken into account. Once your order is processed and ready for shipping we will email your Order Confirmation to you. Please refer to our Website or a Customer Service Representative for any additional information. ME will do our best to meet the estimated delivery time on your Order Confirmation.
In each package, in addition to your purchased product(s) you will find
(i) The ME presentation card, (ii) all additional applicable accessories, if any, (iii) a USE and CARE instruction card, (iv) a packing slip excluding price information, and (v) a printed reproduction of any personalized message you may have requested at the time you placed your order.
ME insures shipments in transit until delivery to you. An adult signature upon receipt is required for all deliveries from ME, at which time all responsibility for the package becomes solely yours.
When placing an order on our Website or through our Customer Service Center you have the opportunity to choose to receive an invoice. If you do not choose to receive an invoice you may still request an invoice at any time by calling our Customer Service Center (at the number on our Website), but your request will be subject to identity verification.
Please note that ME will NOT provide ANY invoice or payment information to ANY gift recipient.
13. CUSTOMER RIGHT OF WITHDRAWAL
European Union customers have a right of withdrawal from any purchase agreement within 7 days without justification. This right of withdrawal period expires 7 days after you or a third party (other than the carrier) indicated by you, have taken the receipt and material possession of any goods.
To exercise your right of withdrawal please contact our Customer Service Center (via the phone number or email address listed on our website) for a Return Authorization Number (RMA), which we will confirm in writing. Otherwise, you must inform ME of your decision to withdraw from this purchase agreement by an unequivocal statement, (e.g., a letter sent by mail or by email).
If you retract your purchase agreement ME will refund all payments received, including standard delivery costs, (excluding any additional delivery costs for a delivery of any type chosen by you other than the least expensive standard delivery method proposed by ME), as soon as possible, and in any case not more than 7 days after we have been informed of your decision to withdraw from the purchase agreement.
We will issue your refund using the same payment method you used for the initial transaction.
14. GIFT RECIPIENT RETURNS
In addition, in order to ensure your complete satisfaction ME offers gift recipients a 7 day return period, provided they strictly comply with our Terms and Conditions. ME will resend to the gift recipient any product a gift recipient violating any of our Terms and Conditions has returned to ME.
In the event of any acceptable product return to ME only one client will be entitled to receive a refund. In any case, the gift recipient may be entitled to a refund or may benefit from the option of an exchange as indicated below.
15. MANUFACTURER'S GUARANTEE
ME scrupulously ensures that every product strictly conforms to the high quality standards applicable to it and that it has met all of our controls, both technical and aesthetic.
Our selected products are covered by the ME International Guarantee. If you would like to return a covered product for repair please read our
ME International Guarantee or call our Customer Service Center (at the phone number provided on our website) for more information.
16. LEGAL GUARANTEE
As a consumer you may have legal quality guarantees afforded you under a national legislation governing the sale of consumer goods. Any such rights are not affected by our Terms and Conditions.

18. PRODUCT DESCRIPTION AND PRICING ACCURACY
Although ME strives for accuracy in publishing the information on our Website, in advertisements, in catalogs, and provided by our Customer Service Center, ME provides no guarantee, neither explicit nor implied, regarding the accuracy, reliability or completeness of any information.
ME does not confirm product prices prior to an ME Order Confirmation being sent, indicating the existence of an obligatory sales contract. If the correct ME product price is higher than the price listed on our Website then ME will either contact the customer for instructions before shipping their order, or if unable to contact the customer, will reject such an order and notify the customer of this rejection.
Although ME strives for accurate descriptions, photographs and graphic representations of our products on our Website, in advertisements and in catalogs, ME does not guarantee that these, nor any other contents are without error, whether by inaccuracy, omission, an obsolete element or for any other possible reason.
Consequently, your remedy in such circumstances, should you choose to exercise this option is to return the product(s) in accordance with Clause 13. CUSTOMER RIGHT OF WITHDRAWAL, as stated above.
19. FINAL CLAUSES

Severability. In the event that any provision of our Terms and Conditions should be considered invalid or unenforceable by a court of law for any reason whatsoever, it would be void or unenforceable to that extent only. 20. APPLICABLE LAW
Our Terms and Conditions are governed by Chinese law and interpreted in accordance with it, and without any reference to any provision concerning a possible conflict of laws and excluding the Convention on the International Sale of Goods (CSIG).
You can initiate legal proceedings against ME in the Chinese courts or in the country where you reside. ME may also initiate legal proceedings against you in the country where you reside.
Without limitation of any formation of an appeal before a court ME and the Customer shall engage in all possible efforts for a period of thirty (30) days to settle amicably any disagreement or dispute that may arise from or be attributed to our product, our Terms and Conditions, or any breach thereof.
